The law on employment rights and obligations in transfers of undertakings is technical and complex. The Acquired Rights Directive, from which TUPE rights flows, is required to be interpreted purposively and the case law of the Court of Justice of the European Union reflects that requirement. This means that the Court can and does change the direction of its interpretation of the Directive. In addition, the law on TUPE is not applied in the same way in Ireland and the UK.
